Booking terms and conditions

Please read the following "Booking Terms and Conditions" carefully, as they contain important information about your legal rights, remedies and obligations. You should not make any booking unless you understand and agree to the following Booking Terms and Conditions. References to "us", "us" and/or "our" in these Booking Terms and Conditions shall refer to the Independent Travel Consultant as set forth in your quote, tax invoice and/or itinerary (as applicable). References to "FCTG" in these Booking Terms and Conditions refer to Flight Center Travel Group Mexico. References to "you" and "your" in these Booking Terms and Conditions refer to the customer.

By making any booking, you agree to abide by and be bound by these Booking Terms and Conditions. These Booking Terms and Conditions apply to any booking you make with us (in person, by phone or by email). The contract formed under these Booking Terms and Conditions is with us, and not with any other party such as FCTG or any travel service provider (such as an airline).

We will rely on the authority of the person making the reservation to act on behalf of any other travelers in the reservation (regardless of whether other travelers have made separate payments) and that person will bind all such travelers to these Booking Terms and Conditions.

 

 

1. Passports and Visas:

All travelers must have a valid passport for international travel and many countries require at least 6 months of validity from the date of return. For international travel reservations, you must inform us if you have less than 6 months of validity in your passport. When assisting with an international travel reservation, we will assume that all travelers on the reservation have a valid passport that is valid for the applicable destination and transit point. If this is not the case, you must inform us. It is important that you make sure you have valid passports, visas, and re-entry permits that meet the requirements of immigration and other government authorities. Any fines, penalties, payments or expenses incurred as a result of said documents not meeting the requirements of those authorities will be your sole responsibility (except to the extent that they are caused ​_d04a07d8-9cd1- 3239-9149-20813d6c673b_because of us). If you need information on visas, passports and other travel document requirements for your trip, please let us know. We can provide you with general information only about the visa and passport requirements that apply to international travel reservations you make with us. We may also obtain more specific information from a third-party visa advisory service provider on your behalf (if you wish, we can help you obtain visas through this third-party service and fees will apply).

2. Travel documents:

Travel documents include (without limitation) airline tickets, hotel vouchers, travel vouchers, or any other document (whether electronic or otherwise) used to confirm an agreement with a travel service provider. Travel documents may be subject to certain conditions and/or restrictions including (without limitation) that they are non-refundable, non-reschedulable, and/or subject to cancellation and/or other change fees. Travel documents cannot be transferred to another person for their use. All airline tickets must be issued in the name of the holder of the passport/photo ID. Your name on your passport, visa and other travel documents must all be identical. An incorrect name on a reservation may result in the inability to use that reservation, the cancellation of the reservation, and the application of additional charges for changes and/or cancellations. Please review your travel documentation carefully and notify us immediately of any errors in names, dates or times. It is your responsibility to review all documents before traveling. In the case of physical documents, these will be available for collection 2 weeks prior to departure date, however this will depend on your individual arrangements. Please contact us to confirm when your travel documents will be ready for pickup. In case they are inside the republic, there will be the possibility of home delivery.

Be sure to read your travel documents carefully for details on baggage allowances, as they can vary from airline to airline and country to country. Excess baggage (if allowed by your airline) can be expensive and is your responsibility. We will not be responsible for any expenses, fees, penalties, costs, liabilities, damages or losses associated with baggage allowances and excess baggage.

3. Travel insurance:

We strongly recommend that you take out suitable travel insurance to cover your travel arrangements. Your insurance protection should include at least cancellation coverage, medical and repatriation expenses, personal injury and accidents, death and loss of personal baggage and money, and personal liability insurance. Upon request, we must be provided with evidence of such insurance. Insurance coverage offered by credit card companies or reciprocal health coverage agreements are often not comprehensive. The Department of Foreign Affairs and Trade strongly recommends travel insurance for all trips abroad.

4. Travel advice, including COVID-19 (Coronavirus) guidance:

We recommend that you contact the Secretary of Foreign Relations (SER) or visit their website at https://www.gob.mx/sre for general travel advice, as well as specific advice (including security alert levels) related to the destination you want to visit. We strongly encourage you to familiarize yourself with the current status and updates on border and immigration arrangements during the COVID-19 outbreak, available at https://coronavirus.gob.mx/

 

In addition, you should familiarize yourself with airline requirements regarding passenger safety, including the requirement for face masks and the need to present evidence that meets airline and border control requirements regarding a negative test for COVID-19 for both transit and final destination passengers. This information is subject to change without notice, so we recommend that you update it in relation to the applicable government and airline policies for your transit and final destination at each of (i) the time of booking, (ii ) as your travel date approaches, and (iii) immediately prior to travel.

You acknowledge that you choose to travel at a time when you may be exposed to the coronavirus. It is your own responsibility to familiarize yourself with all relevant travel information, including applicable health risks. You acknowledge that your decision to travel is based on your own consideration of this information, and you acknowledge and agree that you are aware of and assume responsibility for the risks associated with traveling at this time. To the fullest extent permitted by law, we do not accept any liability in connection with these additional risks.

5. Health:

You should ensure that you are aware of the health requirements and recommended precautions relevant to your travel reservation and ensure that you bring all necessary vaccination documentation with you. In some cases, failure to present required vaccination documentation (for example, proof of yellow fever vaccination) may deny you entry into a country. We recommend that you check with your local doctor, travel medical service or specialized vaccination clinic before starting your trip. 

The ability to accommodate any medical request, including (without limitation) access to electricity, refrigeration, and use of mobility aids, is subject to the travel service provider's sole and absolute discretion and will often depend of a number of factors, including (without limitation) any mode of transportation and local standards at the destination. All medical requests are beyond our control. While we will include all medical requests as a file note to the travel service provider, we cannot guarantee that your request will be honored. It is your responsibility to follow up with the travel service provider directly at the destination or prior to travel where possible.

6. Prices:

All prices are subject to availability and may change without prior notice. The price is only guaranteed until once you have paid the reservation in full. Please note that prices quoted are subject to change. Price changes may occur for reasons beyond our control that increase the cost of the product or service. Such factors include, but are not limited to, adverse currency fluctuations, fuel surcharges, taxes, and airfare increases. Please contact us for updated prices.

 

7. Financial arrangements

We receive remuneration through commissions, financial incentives, and other means (collectively, "financial arrangements") for booking travel and travel-related products and services on your behalf with third-party travel service providers. We are not required by law to disclose the nature or value of these financial arrangements.

8. Deposit and Final Payment:

You will be asked to pay a deposit, deposits or the full value of the services at the time of reservations. We will inform you how much it will be. All deposits are non-refundable if you change your mind or cancel, or if the travel service provider's terms and conditions state that your deposit is non-refundable. If your deposit is refundable, this is subject to us having received the funds from the travel service provider and/or the travel service provider authorizing us to refund your deposit. A deposit will secure your reservation/seat, however prices listed may change prior to final payment. The final payment will be required according to the requested service. Some airfares or services must be paid in full at the time of booking.

9. Our change and cancellation fees:

Any change and cancellation fees that will apply to your reservation are set forth in your quote, tax invoice, and/or itinerary (as applicable) and as set forth in sections 10 through 14 below:

Payment of change or cancellation charges by credit card may generate the corresponding credit card surcharge.

All bookings are made on your behalf subject to the terms and conditions imposed by the travel service provider. If, for example, a travel service provider's terms and conditions contain a "no refund policy", we will only be able to provide you with the remedy provided by the travel service provider (if applicable), which may include a travel credit provided by the travel service provider.

10. Travel Service Provider Change and Cancellation Fees:

Reservations changed or canceled for any reason (including matters beyond your control or our control) may also incur travel service provider fees, which may be up to 100% of the cost of the reservation, regardless of whether the journey has begun. Travel service provider fees may also apply when a reservation is changed for any reason and when tickets or documents are reissued. Where we incur any liability for a change of travel service provider or cancellation fee for any reservation that is changed or canceled for any reason, you agree to indemnify us in the amount of that fee. When you request a refund for a modified or canceled booking for which payment has been made to the travel service provider, we will not refund you until we receive the funds from that travel service provider (which may take 12 weeks or more). , it depends on the processing time of the travel service provider. In the event that we still have the funds, we can only provide you with a refund once the travel service provider authorizes us to process your refund, subject to that travel service provider's change or cancellation policy.

11. Change or cancellation by you:

If you change any aspect of your reservation, we will do our best to accommodate your request, but it may not always be possible. All changes will be subject to any applicable travel service provider fees and any change fees set forth in your quote, tax invoice, and/or itinerary (as applicable), and you may be responsible for any price increases that may occur. occur as a result of your change request.

If you cancel any aspect of your reservation, your deposit will be forfeited and you will be required to pay the applicable travel service provider fees and cancellation fees stated in your quote, tax invoice and/or itinerary (as applicable), and we will provide you with a refund for remaining funds (if applicable).  If your deposit or reservation is refundable, this is subject to us having received the funds from the travel service provider and/or they authorizing us to refund your deposit or reserve funds.

For instant purchases or non-refundable reservations, if you cancel any aspect of your reservation, you will not be entitled to a refund, travel credit or other remedy from the travel service provider or us.

12. Change or Cancellation by a Travel Service Provider:

The following terms apply to a cancellation by a travel service provider, except in the case of unavoidable or extraordinary circumstances (discussed in sections 13 and 14 below).

To the extent permitted by applicable law, if your booking is canceled by a travel service provider, the travel service provider will generally in the first instance offer you alternative travel arrangements of a comparable standard if available (and will refund any difference in price if the alternative is of a lower value), or a travel credit for the full amount paid by you. Alternatively, subject to the travel service provider's change or cancellation policy, the travel service provider may offer you a refund of all monies paid by you in respect of the booking, of which the travel service provider and/or or we will deduct any non-recoverable costs, and any applicable travel service provider fees and our applicable cancellation fees.

"Irrecoverable Costs" means all reasonable direct and indirect costs incurred by the travel service provider and/or us in connection with your booking, including amounts paid by us to other relevant travel service providers that you are responsible for the components of your reservation and that may be non-refundable. For example, costs paid to tour or transfer operators at the destination abroad.

For instant purchases or non-refundable reservations, if your reservation is canceled by a travel service provider, subject to the travel service provider's change or cancellation policy, you may not be entitled to a refund, travel credit, or other travel service provider resource. I we.

13. Unavoidable or Extraordinary Circumstances:

In the event of unavoidable or extraordinary circumstances, a travel service provider may materially modify or cancel your reservation as set forth below.

In these Booking Terms and Conditions, "unavoidable or extraordinary circumstances" means any cause beyond the reasonable control of a travel service provider that could not have been prevented or avoided even if the travel service provider had taken all reasonable measures. reasonable (including, but not limited to, war, threat of war, riot, civil unrest, industrial conflict, terrorist activity and its consequences, plague, epidemic, pandemic, infectious disease outbreak, or any other public health crisis (including quarantine or other employee restrictions), natural or other disaster (such as volcanic ash or hurricanes or similar events), nuclear incidents, fires or forest fires, severe weather conditions (actual or threatened, including snow and fog), closed or congested airports or ports or other modes of transportation, unavoidable technical problems with transportation, impr Changes in transportation schedules, transportation interruptions or cancellations, national and/or international travel restrictions, changes in travel notices and restrictions, changes in health and quarantine notices, changes in immigration and labor laws, plane rescheduling or ships or other modes of transportation, changes in applicable laws and/or other government mandates (including evacuation orders and border closures), and similar events. A material change is one that has a serious impact on your reservation and would cause you considerable inconvenience (including a change of departure date, departure point or airport, or a change of departure time of more than twelve hours).

14. Cancellation due to Unavoidable or Extraordinary Circumstances:

If your reservation is canceled due to unavoidable or extraordinary circumstances, the travel service provider will offer you a travel credit or we may, subject to any applicable hardship policy, offer you a travel credit in the full amount you paid.

15. Emergency Assistance

Where we have used FCTG services to facilitate your travel booking, FCTG's emergency support team is available to assist you with urgent inquiries about your travel booking and FCTG products outside of business hours if we are not available to assist you personally. You will be charged fees for the provision of such assistance. Contact details for FCTG's emergency support team and details of any fees that will apply are set out in your quote, tax invoice and/or itinerary (as applicable).

Payment of FCTG's emergency assistance fees by credit card may result in the corresponding credit card surcharge.

16. Credit and Debit Card Payments:

Any credit card surcharges stated in your quote, tax invoice and/or itinerary (as applicable) will be applied when paying by credit or debit card.

You authorize us to charge all fees incurred by you in connection with the services provided by us to the credit or debit card designated by you. If payment is not received by the card issuer or its agents for any reason, you agree to pay us all amounts due immediately upon request.

If you choose to store your credit card details with us, they will be stored securely and can be used for your future transactions with us (including transactions agreed by phone or email). You can choose to delete your saved credit card details at any time.

17. Payments by Check:

Please note that check payments require approximately 5 business days to clear. If you are paying with this method, you will need to make the payment at least 5 business days before the actual payment due date. You agree not to stop payment on the check even when your reservation is canceled for any reason (including matters beyond your control or our control). You agree that we may apply the proceeds of the check to satisfy any liability you have to us, including any liability with respect to cancellation charges, before we refund the balance to you.

18. Taxes:

Airfares are subject to change and are confirmed at the time of air ticket issuance. There may also be a local tax charged at some airports.

19. Agency:

We act as agents and sell various travel-related products as agents on behalf of numerous providers of transportation, accommodation and other services, including airlines, trains and cruise ships, as well as all of our wholesalers. Any booking, advice and other services (such as processing a change or cancellation with the relevant travel service provider) that we provide to you are a guarantee of that relationship with the agency. We are not acting as an agent and are not authorized to enter into any agreement with you on behalf of FCTG.

Our obligation to you is (and you expressly authorize us to) provide reservation and advisory services, including making travel reservations on your behalf and arranging relevant contracts between you and travel service providers. We are careful in selecting reputable travel service providers, but we are not a travel service provider ourselves and have no control over or responsibility for services provided by third parties. All reservations are made on your behalf subject to the terms and conditions, including conditions of carriage, cancellation policy and limitations of liability imposed by these travel service providers. Upon request, we can provide you with copies of the terms and conditions of the relevant travel service provider. Your legal rights in connection with the provision of travel services are against the specific travel service provider and, except to the extent that a problem is caused by our fault, are not against us. In particular, if for any reason (except our fault) any travel service provider is unable to provide the services you have contracted for, your rights are against that provider and not against us.

 

20. Liability:

To the extent permitted by law, we do not accept any contractual, tort or other liability for injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused by ​_d04a07d8-9cd1 -3239-9149-20813d6c673b_directly or indirectly for the acts, omissions or non-compliance, whether negligent or not, of third-party providers over which we have no direct control, force majeure, provider insolvency or any other event beyond our control or that cannot be prevented with reasonable care on our part. Our liability will also be limited to the extent that any relevant international convention,

21. Special requirements:

Please contact us regarding any special requirements you may have for your travel arrangements, such as special meal and seat requests, room type, or handicap access.

 

22. Frequent flyer program or other loyalty program:

Please let us know your frequent flyer membership details (or other applicable loyalty program details) to include in your booking. Check your frequent flyer program (or other applicable loyalty program) for the specific terms of your membership. We cannot guarantee that your frequent flyer or other loyalty program provider will credit you with points for your booking or provide you with any other particular benefits, including (but not limited to) status credits or lounge access. It is your responsibility to verify if your reservation is eligible for such benefits.

 

23. Schedule changes:

We recommend that you contact the travel service provider to confirm your scheduled departure time 24 hours prior to your departure.

 

24. Privacy Laws:

We are committed to protecting your personal information and agree to handle your personal information in accordance with applicable privacy, data protection, data breach notification, and anti-spam laws ("Privacy Laws"). By providing us with personal information, you agree to our collection, use and disclosure of your personal information as provided in these Booking Terms and Conditions, in accordance with all Privacy Laws. In particular, you agree that in certain circumstances (such as when you ask us to book international travel for you), we are permitted to disclose your personal information to recipients abroad. Such recipients may include overseas travel service providers (for example, airlines, accommodation, or tour providers) with whom you make a reservation. In most cases, these travel service providers will receive your personal information in the country in which they provide services to you or in which their business is based. We may also disclose your personal information to service providers that provide services to us inside and outside of Mexico. We will generally only disclose your personal information to these entities and/or individuals in connection with facilitating your travel booking and/or to enable them to provide administrative and technical services on our behalf. When we disclose your personal information to any entity and/or person (including recipients abroad), you agree that: (i) in the case of travel service providers or other recipients who provide services directly to you, we will not we will not be required to ensure that the recipient complies with Australian privacy laws nor will we be responsible for how they handle your personal information and you acknowledge and agree that your rights in relation to the handling of your personal information are governed by the contract between you and that recipient (which may include your privacy policy); and (ii) in the case of travel service providers who perform services for us, we will take reasonable steps to ensure that the recipient complies with privacy laws. 

 

25. Money not held in trust:

You agree and acknowledge that such monies you have paid to us will not be held by us in trust for you and on your behalf, and we may hold such monies in any account we deem appropriate, including our own money and/or that of other customers. Any money you pay us will be due and payable to the travel service provider in accordance with the payment terms agreed with that travel service provider. Payment will generally be made to the travel service provider before the services to which the money relates are provided; however, in some cases, payment will be made to the travel service provider after the services to which the money relates have been provided. With respect to money paid for flights for an IATA airline, such money may be held in trust for that IATA airline in accordance with the payment terms agreed with that IATA airline.

 

26. Modifications of these Booking Terms and Conditions:

We reserve the right to modify any of these Booking Terms and Conditions at any time without notice. If we make changes to any of these terms and conditions, we will post the changed terms and conditions on the Website, Applications or Services, effective upon posting. The applicable terms that apply are those in effect at the time you make a reservation with us.

 

26. Recognition:

You acknowledge that you are 18 years of age or older and that you understand and agree to the above Booking Terms and Conditions.
